This website is owned and operated by Xarmony LLC. The following statements set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors safe and cruelty free handcrafted perfumes of premium quality. All Xarmony fragrances are made in house by our perfumer, Trill Noel, under the regulations set forth by the FDA, RIFM, and IFRA (51st Amendment) safety restrictions. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

USER AGREEMENT

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process. (You the buyer agrees to buying the item and Xarmony, the seller, has agreed to sell you the item.)

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

RETURN & REFUND POLICY

At Xarmony, we pride ourselves on the quality and craftsmanship of our artisanal perfumes, made exclusively in small batches with premium ingredients sourced from reputable aromachemical suppliers like Givaudan, Takasago, Robertet, Firmenich, and IFF. In order to ensure the highest level of excellence, each perfume is meticulously formulated, assembled, packaged, and cared for by Trill Noel at our perfumery studio located in Baton Rouge, Louisiana. Due to the nature of our handcrafted products and the commitment we have to maintaining the highest standards, we regret to inform you that we have a strict no refund policy in place. Thank you for understanding and supporting our dedication to creating exceptional fragrances.

With this in mind, we understand that fragrance can be subjective. We recommend customers to purchase samples in order to discover the olfactive experience that most appeals to their individual tastes. In this way, we hope to offer customers a fair and affordable evaluation of our collection before committing to a full size purchase.

Returns / replacement will only be accepted for products that are received damaged/ defective. Otherwise, as decided at our discretion.

Shipping cost is non-refundable for returned, undelivered, unclaimed or packages that are refused. Any shipping cost you incur to return the product to us will not be refunded. The only exception to this is if we have made a shipping error.

The customer will be liable for the shipping cost involved when returning the product.

In the event that a customer decides to cancel an order within 12hours of placing a cancellation can be requested.

Sale items (if applicable)

Only regular priced items/ items purchased at full price may be refunded. Unfortunately sale items cannot be refunded. Promotional, discount, sale purchases are unable to be refunded or exchanged.

The following products cannot be returned:

Products that are personalized, bespoke, altered or otherwise made to your specification. The bespoke process, if cancelled before completion, does not warrant a return.

RETURN INSTRUCTIONS

Damages due to neglect, improper usage or application will not be covered under our returns policy.
Returns should be carefully packed by the customer to avoid transit damage.
Return requests are to be made within 7 days of receiving the parcel.

Please notify us via email for return approval. Any return mailed without prior approval will be rejected.

MODIFICATION OF TERMS

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

PAYMENT PROCESSING

All direct payment gateways offered and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

PROMOTIONS

Discount codes are valid only for the specified promotion period and cannot be combined with other offers, discounts, or promotions unless explicitly stated. The use of multiple discount codes on a single purchase outside of those listed in our promo code section, is not permitted unless authorized by the company. Any attempt to misuse or artificially inflate discounts may result in cancellation of the order, denial of promotional benefits, or other enforcement actions at the company's sole discretion. The business reserves the right to modify or cancel the offer at any time, for any reason, without notice.

Any discount code available in our designated promo code section at any time is deemed valid for use, regardless of other ongoing offers or promotions, unless explicitly stated otherwise. We do not consider this to be a form of misuse as all prices listed on site are determined with our on site codes in consideration. Codes listed in our promo section may be combined with other on site discounts or offers unless specifically restricted. All other terms regarding the use and restrictions of promotional codes, including their validity period and restrictions on multiple uses, remain in effect as outlined, and the company reserves the right to modify or cancel any promotion at its sole discretion.

All items purchased during any promotional period are final sale and are nonrefundable. No refunds or exchanges will be issued for products bought under this promotion, regardless of the reason. Please note all items, at any time, are covered by our replacement policy for defective or damaged products as per the terms outlined in our guidelines. By completing your purchase, you agree to these terms.

COMMUNICATION

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees (in the event we must reship due to customer error), to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail. As per normal policy with most companies.

By accessing or using our website and services, you acknowledge and agree to the following terms regarding third party transfers and purchases of perfume:

Third Party Transactions: Outside platforms may facilitate transactions involving the purchase, transfer, or exchange of perfume products between users and third parties. However, we are not a party to these transactions and do not endorse, guarantee, or assume any responsibility for the quality, safety, legality, or performance of any perfume sold or transferred by third parties.
Disclaimer of Liability: To the fullest extent permitted by applicable law, Xarmony, its affiliates, officers, directors, employees, agents, and representatives shall not be liable for any claims, damages, losses, or expenses arising out of or related to any third party transactions involving perfume, including but not limited to:
- Any inaccuracies or misrepresentations of product descriptions, pricing, or availability by third parties.
- Any disputes or issues arising between you and third parties regarding the performance, delivery, or quality of the perfume.
- Any allergic reactions, adverse effects, or other health-related concerns resulting from the use of any perfume purchased or obtained from a third party.
User Responsibility: You are solely responsible for conducting due diligence regarding any third party with whom you engage in transactions involving perfume. We recommend thoroughly researching, verifying, and considering the credibility of any third party before proceeding with a purchase or transfer.
Indemnification: You agree to indemnify and hold harmless Xarmony from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your interactions with third parties or any purchases or transfers of perfume.

By using our services, you acknowledge that you have read, understood, and agreed to this Limitation of Liability clause regarding third party transfers and purchases of perfume. If you do not agree, please refrain from using our platform.

BRAND SAFETY

Our Perfumes contain alcohol and are for external use only, DO NOT CONSUME. This product is not intended to diagnose, cure, mitigate, treat, or prevent any disease. No liability will be assumed by Xarmony LLC arising out of the misuse of our product.

Please keep perfumes out of reach of children and keep away from eyes and mucous membranes. Keep away from naked flame or direct heat sources. Do not apply to sensitive skin. Do not apply to broken or inflamed skin. Please perform a small skin test before use. If irritation develops, reduce frequency, or discontinue use.

If redness, burning, itching or irritation occurs, stop using product immediately and consult your medical provider if self-treatment is not effective. If irritation does occur, wash with soap and water to clean the affected area of any oils or residue that may remain. If you are pregnant, nursing, have heart disease, epilepsy, high blood pressure, diabetes, skin sensitivity, or have any medical condition that can be affected by perfume seek the advice of a health professional before using any perfumes.

We do our best to provide products that are as safe to use as possible. However, it is impossible to predict individual allergic reactions to each product – fragrance – or ingredient in the product or combination of ingredients in the product. Some people can have an allergic reaction to a specific ingredient or any combination of ingredients in food, skin care products, or perfume at any time. We pride ourselves on ensuring that our products abide by all health and safety regulations.

If you have any allergic tendencies, please approach the use of perfumes, not just our own but all, with caution.

Currently Xarmony LLC does not offer PR opportunities outside of collaborating with customers and patrons of the brand. We are very supportive of our community and take pride in honoring the contributions of our valued patronsWe are in the process of expanding and hope to accommodate such an endeavor in the future.

HUMAN OPERATED

Please note that Xarmony is a small, independently operated business run solely by one individual. All perfumes are meticulously handcrafted by the perfumer. While we strive to provide high-quality products and excellent service, please be aware that as a single-person operation, errors, or inconsistencies may occasionally occur. By using our website and purchasing our products, you agree to accept that Xarmony cannot be held liable for any mistakes, inaccuracies, or delays arising from our limited capacity as a small business. Xarmony reserves the right to offer solutions and resolutions in order to make things right in such situations, as we are committed to honoring and valuing our patrons. Our goal is to ensure that every experience with our brand is as positive as possible, and we always strive to prioritize your satisfaction and trust. We appreciate your understanding and support.

Force Majeure

Xarmony LLC shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.

Xarmony refuses responsibility for any and all situations outside of our reasonable control, including actions taken by those after usage of our products/ inclusion in social media content etc.
